How To File An Employment Complaint

The Equal Employment Division (EED) begins its complaint investigation process shortly after receiving a complaint that meets the jurisdiction requirements covered within the Georgia Fair Employment Practices Act. The EED will either investigate the complaint or refer the complaint to the U.S. Equal Employment Opportunity Commission to investigate. Throughout the investigation, the EED will make efforts to help the parties reach a mutual agreement through a conciliation process. If the complaint cannot be resolved voluntarily by an agreement, the EED may issue findings from the investigation. 

In order to file a complaint, the following two factors must be met:

  • Standing (State Government Employees Only)
  • Timeliness (Any complaint filed under the Georgia Fair Employment Practices Act must be timely. In order for the GCEO to have jurisdiction to investigate, complaints must be filed within 180 calendar days of the alleged discrimination.
